Your rights

Under the GDPR your rights are:

  1. To be informed – we must make available this privacy notice with the emphasis on transparency over how we process your data.
  2. Access – you are entitled to find out what details we may hold about you and why.
  3. Rectification – we are obliged to correct or update your details.
  4. Erasure – this is also known as the right to be forgotten.
  5. Restrict processing – you have the right to ‘block’ or suppress the processing by us of your personal data.
  6. Data portability – you have the right to obtain and reuse your personal data you have provided to us.
  7. Object – you have the right to object to us processing your data in relation to direct marketing and or profiling.

Customers

Our customers are employees of organisations involved in the manufacture, delivery, hire or storage of motor vehicles. Our customers may include, but are not limited to, Original Equipment Manufacturers, Ports, Shipping Companies, Vehicle Dealers, Pre-Delivery Inspection Centres and Claims Handlers.

Degould Ltd is the ‘Controller’ of any personal data we collect from our customers (“you”), or that you, or others working with us, provide to us in the course of conducting our business. This Privacy Statement sets out the basis on which we will process this data.

What information will we collect?

We will collect and store: your name, employer, position, email address and contact details. We may also collect your IP address and cookies (website). These can be collected via our website, help-desk, database, app or via written correspondence, phone calls, emails or face to face meetings.

We will collect data from you in relation to the provision of our services to you including details relating to bank accounts, tax affairs and statutory returns.

We may require details from you such as driving licence, passport or birth certificate in order to comply with any identification and anti-terrorism legislation.

When using our digital services such as our website we gather data from you using cookies and other internet tracking software such as Google analytics. The purpose of this is to understand how you are using our services and to be able to offer improvements.

We collect and store CCTV and digital images for the purpose of providing our core products including remote support services.

We also embrace the use of social media and may wish to process any comments made public by you.

In addition, for nominated customer survey contacts, we will request, collect and process your comments and opinions on our service performance. Customer survey information is collected by phone, by email or in person.

Do we use ‘cookies’?

Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. How will we use this information?

The purpose for collecting this information is to carry out our legitimate business.

We will use your contact details to:

  • contact you in relation to a current, completed or proposed sales enquiry or project;
  • contact you in relation to an outstanding help ticket;
  • invite you to business events hosted by us; and
  • send you business updates on our activities.

 

We will use your customer survey scores, comments and opinions on our business performance, on an individual or consolidated basis, to:

  • monitor and report internally on the provision of our services to you and other customers; and
  • evidence to other organisations how we have performed in terms of customer service.

 

We consider these activities to represent legitimate interests in pursuing our ongoing business.

How will we process and store this information?

Contact details will be stored in electronic format on our company database identifying individual people by name, employer and position, and searchable by the same criterion. This information is available to all Degould Ltd employees. Data is stored indefinitely but deleted if no transactions have taken place for six years.

Customer survey information (scores, comments and opinions) will be entered into an electronic database and stored in an access controlled area of the Degould cloud based storage system. The raw data identifies the person who provides the customer survey information related to specific projects. The data is aggregated to analyse trends. The raw data is stored on the Degould Ltd cloud servers for 6 years after which it is deleted.

How will we share or disclose this information?

We do not share your information with any third-party marketing companies.

We use third party service providers to help us run our business and provide services to you. These include:

  1. Cloud accounting service provider – Quickbooks
  2. Payroll – 3rd party
  3. Email – Google
  4. Document storage and management systems – Amazon Web services
  5. Software version control – Github
  6. Issue tracking software – JIRA

Your contact details may be shared with:

  • third parties involved in the delivery of the same or similar projects being delivered, or bid for, by Degould Ltd.
  • a prospective customer seeking a reference from previous/current customer during their tendering process.

 

The following customer satisfaction data is shared inside our business:

  • Individual surveys with scores, opinions and comments (raw data) are sent to the Managing Director and may be shared with other project team members.
  • Aggregated customer satisfaction scores are shared on the Degould Intranet, and in board reports, as a key performance indicator.

 

Our Data Promise

Degould Ltd is committed to respecting and protecting your data whilst it is in our care. We have strict policies and procedures in place to protect your data. We take your right to privacy seriously and will always seek to comply with data protection legislation.

We will not sell or transfer any personal information outside Degould Ltd except where we are required to do so by law by the police or other regulatory or governmental authority.

Data Privacy Officer

Updating us with your information

You can help us to keep your information up to date.  If you would like us to remove or correct any information we hold about you, please inform us of changes by emailing wynn.s@degould.com.

Access to Information

You have the right to access personal information concerning you and obtain information about it, including the purposes for which it is being processed, the categories of personal data concerned and any recipients or categories of recipients of the data. This is called a subject access request (“SAR”). However, if it is felt that a request is manifestly unfounded or excessive, Degould Ltd may:

  • charge a reasonable fee which will take into account the administrative costs of responding;
  • ask the individual to specify the information the request relates to; or
  • refuse to act on the request.

In order to make a SAR you are required to provide information that will act as proof of identification (i.e. date of birth or NI number) and are asked to send these requests to wynn.s@degould.com.   Information will be provided without delay and at the latest within 28 days of receipt.

You have the right to request for your data to be erased (“right to be forgotten”) in circumstances where:

  1. the data is no longer necessary for the purpose in relation to which it was collected;
  2. consent to processing has been withdrawn (if consent to process the personal data was the reason relied upon for collecting);
  3. the personal data was processed in breach of the GDPR;
  4. the personal data has to be deleted to comply with a legal obligation; or
  5. you object to the processing and there are no compelling grounds to trump that objection (such as the data being required in legal claims involving the Company).

Please note that Degould Ltd can refuse to comply with a request for erasure where personal data is processed for the following reasons:

  • to exercise the right of freedom of expression and information;
  • to comply with a legal obligation or for the performance of a public interest task or exercise of official authority;
  • for public health purposes in the public interest;
  • archiving purposes in the public interest, scientific research historical research or statistical purposes; or
  • the exercise or defence of legal claims

 

Right to Complain

If you are unsatisfied for any reason, you have the right to lodge a complaint with the supervisory authority at the Information Commissioners Office (https://www.gov.uk/data-protection/make-a-complaint).
